Oh I agree. But officers will lie and say whatever they need to in these situations which is why it’s always best to record the encounters. Easier to beat them in court instead of on the side of the road.
I’ll never do a field sobriety test but under a real threat of arrest I’d rather do the chemical test since I technically agreed to it when I got my license then fight them in court.
Usually cops are the ones trying to build a case against you. I would rather flip it and build a case against them.
@S2iENT@notfixed252106@RTNToronto It’s not required to do a field sobriety test by law but he is required by law to take a chemical test or face having his license suspended for a year. You agree to this when you get your driver’s license.
By federal law they must be able to speak, read and write in English proficiently. Hence the reason if they can’t means they obtained a CDL illegally.
With that being said this guy was likely distracted on his phone, maybe been in the road too long or cracked out of his mind. No human simply forgets to hit brakes.
