#IAS officer Archana Singh was removed from the post of Secretary, Infotech Communication, Govt of Rajasthan because of a technical glitch which led the screen in PM Modi's rally went blank for 10 minutes.
Compare this with situation in #Tax portals in #Finance Ministry, whether it's #Incometax #GST #MCA which are having so many glitches since inception, even courts have directed to resolve, which led to penalties, late fees of thousand of crores on taxpayers and wasted critical time of tax professionals who are helping govt to collect taxes and ensure tax compliance.
Article 370 was removed and govt said , 1 देश में 2 निशान, 2 संविधान नहीं चलेंगे then why no action is taken on officers and service providers by @FinMinIndia for those who are responsible for these glitches?

This appellate tribunal was supposed to launched in 2017. Imagine a government officer passed a wrong order against you in 2017 and you had no remedy except bribe in past 8 years.
BREAKING: The Central Board of Direct Taxes (CBDT) has decided to extend the specified date for filing various audit reports for the Previous Year 2024–25 (Assessment Year 2025–26), from 30th September 2025 to 31st October 2025, for assessees referred to in clause (a) of Explanation 2 to sub-section (1) of section 139 of the Act.

BREAKING: ORDER OF RAJASTHAN HIGH COURT RELEASED: As an interim measure, the respondents are directed to extend the due date for filing Tax Audit Reports for AY 2025-26 from 30th September, 2025 to 31st October, 2025.
The respondents are further directed to resolve the technical glitches on the e-filing portal efficiently and expeditiously, thereby facilitating seamless compliance by taxpayers.

Rajasthan and Karnataka High court have directed CBDT to extend #Taxaudit due date, also directs to keep #Incometaxportal glitch free which they will review later in a month. Today CBDT said in Delhi High court that they are studying the orders and will take final decision by end of day
There are some posts which updated that Department is going to file a SLP in #Supremecourt against the decisions.
But, I feel #Incometax department will not approach #Supremecourt
Reasons:
1) High court directions are very loud and clear that there are problems in the portal, and if not resolved and date not extended, hundreds of writs will be filed across court. In 2015, CBDT adhered to directions and extended due dates.
2) Over 100 plus Representations from Chambers of commerce, Udyog bharti, MSME federation , taxpayers organisations, tax professional associations, ICAI , MPs and other organisations have been submitted in last 2 months regarding various glitches on portals have been submitted to PMO, FM, CBDT.
3) CBDT themselves have agreed that there are structural chances in Returns and forms, and development of utilities will take time and suomotto extended due date on 27th May 2025 for filing of NON Audit ITRs however that time did not extended the due date of filing Tax audit forms thereby giving only 15 days of time for taxpayers and tax professionals to comply unthoughtful deadline.
4) ICAI has already submitted screenshots of the glitches faced to CBDT , Over 1200 glitches were reported in just span of 3 days to ICAI from CAs across country.
5) There is NO REVENUE LOSS to govt even if they extend due date of filing tax audit report.
6) This year , the various glitches on the #Incometax portal , there is a degrowth of 2.73 % in number of ITRs filed till 15th september compared to last year till (when due date was not extended and portal was working very fine). This year in the last 4 days, there is reduction in number of ITRs filed daily as portal was out of order most of the times and was giving various glitches. Income tax department even blocked third party softwares to reduce the load on the portal which incrsaed the work load further. in 2022, peak ITRs filed on a day were 72.42 Lakhs which was a record, last year also 70 lakh ITRs were filed on due date of 31st July 2024. This clearly suggest that #CBDT could not provide glitch free portal to users.
These all points are already submitted to various high courts and they have taken cognisance of the same. Hence even if CBDT approaches Supreme court, it will be very difficult for it to prove otherwise.
Hence i am of the opinion that CBDT will avoid going to SC , and even if they do, then Supreme court will direct them to be a facilitator and good administrator rather than creating unnecessary hurdles. Accountability is all it is about.
Update on 25 Sep. Today’s Proceedings in Tax Audit due date extension matter:
The Department submitted in the morning that, in view of the recent decisions of the Hon’ble Rajasthan High Court and the Hon’ble Karnataka High Court extending the due date for filing Tax Audit Reports till 30.10.2025, the Central Board of Direct Taxes (CBDT) is holding a meeting today to take a decision on the matter.
On this basis, the Department requested that the matter be taken up tomorrow.
CASA and @CASumitGarg3 have prelimnary placed our submissions on record, and the Hon’ble Court has directed them to await the outcome of the CBDT’s decision for a day.
Accordingly, the matter now stands adjourned to tomorrow.

There is no merit in the case of Dept. going to SC. Extn. brings Zero loss to treasury & addnl. time will Guarantee correct Tax Audits leading to Reliable Financials.
Yes if Dept. pleads earning thru Penalty as merit and SC says a Yes, then it will be the end of Democracy.
Every minute of non extension is a reminder that we are being ruled by illiterate and incompetent clowns who are completely disconnected with the ground realties.
