Dalton “Chud the Builder” Eatherly’s defense attorney’s first public statement is literally:
“Chud might be racist…. But I’m not a racist for taking Chud on as a client! My family loves black people! My grandfather was called the Nigger Coach! If anything, Chud’s behavior is just a larger reflection of this country’s racist progression under a Donald Trump picked Supreme Court! I’m an
impartial attorney, though, and will totally do my best to defend him.”
I don’t think I’ve seen a more insane statement in my entire life from a defense attorney when trying to set the frame for perception on his client and his case.
This is a self defense case, cornerstoned in our 1st Amendment Right to Free Speech.
Chud is an IRL live streamer. You can think whatever you want to about that, but Chud’s entire schtick, what everyone is upset at him for, is posing one SIMPLE question about the 1st Amendment: “Can white people say the word ‘nigger’?”
This is a straightforward, direct legal question, based in the Constitution and the 1st Amendment, with an obvious and simple answer of YES, white people can, in fact, say the all powerful “N word”.
Any other answer short of that full throat affirmation is legally incorrect and an attempted infringement on the Right to Free Speech.
It’s a simple question with a simple answer.
But for some people, it’s not so simple.
Some people would disagree with the Constitution. Someone people want to deny Americans’ their 1st Amendment Right.
And some want to deny them it on the basis of their race.
Because, see, some people don’t think white people get to say that word just because they’re white.
And some people legitimately believe that white people should get their ass whooped just for even THINKING they could say it.
God help them if they dare to utter it.
Joshua Fox was one of those people.
Joshua Fox felt angry that someone dared to defy his rules for what white people could and could not say.
So, when Dalton concluded their initial conversation, agreed to disagree, wished him a good day, and walked away to continue his stream, Joshua felt like he hadn’t made his point.
So what did Joshua do?
Joshua chased down Dalton to try and prove his point.
Joshua approached Dalton. Joshua got in Dalton’s face. Joshua tried to intimidate and provoke Dalton into an altercation by telling him to “Call me a nigger! Mace me! Mace me!” and when Dalton didn’t, Joshua threw the first punch anyways.
This was man who couldn’t handle a simple and legal fact - white people can say “nigger”.
Joshua disagreed, decided to take the law into his own hands, and illegally assaulted Dalton for breaking his rule on what white people can and cannot say. An assault that TO THIS DAY he has still not been charged for.
At the end of the day, Dalton is just a streamer with a simple, gimmicky question that a lot of people don’t like the answer to.
Being a streamer with a question doesn’t mean someone gets to assault you because they disagree with your answer.
Being a streamer with a question doesn’t nullify your right to self defense.
It’s a shame, a performative farce, that charges were ever brought against Dalton Eatherly.
Joshua Fox is the one who tried to physically deprive a man of his Rights. He assaulted Dalton, punched him in the face and continued to beat him as he fell, in order to do so.
Dalton had every right to defend his Rights, physical well being, and life - all of which Joshua Fox voluntarily took it upon himself to threaten the existence of.
