🔥📛 BIG BREAKING UPDATE On 168A of the CGST Act

📢 Gauhati HC quashes Notification No. 56/2023, being issued without Council's recommendation

➡️ Gauhati High Court quashes Notification No. 56/2023 extending the time for issuing demand orders for FY 2018-19 and FY 2019-20, declaring it ultra vires Section 168A.

➡️ The notification falsely claimed it was based on a GST Council recommendation, but the Court found no such recommendation existed.

➡️ A May 20, 2024 Circular and affidavit confirmed no recommendation was made before the notification.

➡️ The notification was only cleared by an implementation committee, which lacks authority, and no recommendation was sought in GST Council meetings.

➡️ The Court ruled the government's action as a colourable exercise of power, misleadingly citing a non-existent recommendation.
