📢 Update from Gujarat High Court – CAAS Writ Petition
When other petitions asked only for extension of dates, CAAS stood firm on a broader principle:
⚖️ Taxpayers should not bear the burden of Govt’s machinery failures.
Adv (Dr.) CA Avinash Poddar argued:
🔹 Utilities are delayed every year since 2015, despite Court directions.
🔹 Portal glitches cripple compliance; advance tax too was hit this year.
🔹 Citizens deserve the full statutory 182 days — not last-minute anxiety.
🔹 Extension is just one interim prayer; the real fight is for accountability & systemic correction.
The Hon’ble Bench pulled up CBDT:
❓ Why issue extension circulars on the last day, causing harassment?
❓ Why ignore the 1-month statutory gap between TAR & ITR?
❓ Why wait until Courts force action instead of proactive governance?

Release utilities & forms by April 1, the correct info is never sent to Ministry. There is never the need of any date extention, set your men & infrastructure in place. When you take credit for filings (though you've done none) own up for the delays and stop shifting it to others
With so many writs pending & audit/accounting work still incomplete, isn’t it time for @icsi_cs to take suo moto cognizance?
How can Accounts be finalized, approved, and AGMs held before 30th Sept under such constraints?
Extension of AGM timelines is also the need of the hour
With shorter timelines and earlier extensions this becomes a genuine need to provide relief asap to Tax payers and Tax Professionals
Moreover, we should partner and derive a permanent solution of this fiasco happening every year and must set he responsibilities at both ends

Nearly 15 plus Writ Petitions have been filed by Taxpayers and tax bar associations across country against @IncomeTaxIndia over unthoughful deadlines of tax audit because of glitches on portal which led to extension of due date of non audit returns by 45 days there by giving time of just 15 days to taxpayers whose accounts needs to be audited and file with ITD by 30th September.
Ours seems to be only country where taxpayers needs to go to court fo demanding natural justice and ease of doing business. @PMOIndia@nsitharaman
