Oh man this is so smart and sneaky from Google. Let me explain their game, and how this will actually play out:
1. Google allows you the option of opting out of AI Mode and AI Overviews. Let's say you choose to opt out. What does this mean?
Users will get their answers from those who will choose to be on AI Mode and AI Overviews, just not from your website.
It doesn't mean AI Mode and AI Overviews doesn't work. It just means it doesn't work for you.
It might work for your competitors, so even thought they'll get a trickle of traffic, you'll get nothing because you won't get invoked.
2. AI Mode and AI Overviews move control up the value chain: Users want answers. Earlier they got it via search results that they scanned. Now Google, ChatGPT, Perplexity gives them answers directly, based on your content.
If you won't exist in AI Mode and AI Overviews, you won't exist for users. That's it. Gone. This might feel like an overstatement, but Google is nudging consumers towards AI Mode as default behaviour, while giving "choice" to publishers. Blue links outside of AI mode will eventually become immaterial.
I wrote in Reasoned today, about Classifieds businesses: When the internet shifts from search/discovery to invocation, businesses don’t get ranked lower. They disappear.
Top of the funnel dies.
Invocation is that transfer of power in the Internet ecosystem.
3. Why is Google doing this? They're creating a facade of choice, while shifting the market (which, lets be honest, Perplexity forced them and ChatGPT to do because of its RAG implementation). They're saying that you had the choice of not opting for AI Mode when actually you don't.
It's a regulatory play, like Robots.txt exclusions for AI in 2023. Google already had Bard up running before they introduced the robots.txt exclusion. Which means they had already scraped your site. robots.txt meant nothing until that point, and the training up to that point was irreversible and without "technical safeguards".
Now, they're allowing you to opt-out. When they go into regulatory meetings, they say: we have "technical safeguards" of opting out. The way the market will function: you won't.
Piracy-as-Input Strategy Template for AI companies
1. Get the data, whatever the source: Licensed data is expensive and slow to acquire; pirated or leaked data is free, aggregated, and immediately usable at scale. Get it.
2. Functional Reframing of unauthorised copying: reframe copying as a technical intermediate step (“training,” “learning,” “non-expressive use”) rather than as consumption or exploitation.
3. Ingestion before legality becomes a discussion: Large actors ingest pirated material at industrial scale before legal standards are clarified or enforced.
4. Irreversible Incorporation: Once ingested, the content cannot be isolated, audited, or removed; consent withdrawal and remediation become impossible.
5. Deferred Accountability: Enforcement is delayed by demands for proof of market-wide harm, despite predictable substitution effects.
Outcome: Piracy shifts from an illegal edge activity to a rational industrial input, enabling permanent value extraction while liability collapses and incumbents consolidate advantage.
This explanation and much much more in my piece on why Text and Data Mining exception for AI is a mechanism for legitimising extraction of pirated data by AI companies.

@azmaftab Great work Aftab, keep thinking in your head that Pakistan won. After all, one needs some kind of mental delusion to get relief after all their major air bases are smoked out in a single night.
