Irrespective of the outcome today in the WP before the KHC, this will be an important milestone in Antitrust Jurisprudence, for the simple reason that today the regulator is keen to investigate the platforms and it put its best efforts in furtherance of same before the KHC.

In the last one year we have seen an increasing trend of antitrust litigation against Amazon globally. Now with the state instrumentality joining the bandwagon it only tilts the balance of scales against Amazon.

@tanvi_ratna The interference? If RBI denies it in the counter affidavit then it will be recorded in the order and that solves the problem. If it admits then it can be tested on Doctrine Proportionality. The issue here is ambiguity of interference not the merits.

Today had the honour of saving 244 fully grown trees from being cut by the govt at Gandipet for road widening works. The Hon'ble HC was pleased to stay the felling of trees on the lunch motion moved by @vata_foundation

Felling should be an exception and translocation a norm!

The Draft E-Commerce Policy is nothing but an eyewash. Without a regulator and a penalty, there is no deterrent for the marketplaces to follow this policy. How about the govt shows same enthusiasm as IT Rules, 2021 in this 100th DRAFT?

@balajis 2. As its a centralised authority it misuses this conflict of interest to its advantage. As an antitrust lawyer representing the independent sellers my concern is there is no solution for centralisation problem in law.

@balajis 1. In India the Antitrust regulator is keen to investigate Amazon. One of biggest concern of the platform is, it's a seller and a manufacturer (Pvt labels) competing with independent sellers and brands. Conflict of Interest!

@balajis 3. At the most it can only behaviour some forms of misuse of this conflict  of interest. But law is slow. Do you see the use case for Blockchain/Decentralisation based platform here? If yes, could you explain in simple terms what it would look like?
