The High Court has cancelled an order that forced a man to pay his ex-wife
Kshs. Fifty Thousand every month.
In the appeal,the lower court had decided the woman was “destitute” and ordered maintenance, yet she had never even asked for alimony in her case. On top of that, she had told the court herself that she’s a professional tailor and businesswoman. The High Court noted that judgment didn't match the facts.
Justice H. Namisi made it clear that in today’s law, men and women are equals. If you’re able to work, you can’t turn your former spouse into your lifetime sponsor.
Maintenance isn’t automatic. It’s a last-resort safety net, not a reward. If you don’t ask for it properly and prove you actually need it, the court won’t give it.
In William & Kennedy Ltd Decision, the CoA was confronted with some interesting argument:
The Appellants argued that the 1st Respondent who was claiming he had bought the Land had no financial capacity then in the 19s & 2000s to raise Kshs 20M & buy the Land just aged 27 years then, and pay the money in instalments in a period of 4½ months & that just running a timber business, income from his father's Rental houses in Pangani, savings & a Coffee Farm could not raise that money.
Interestingly p.97 of the Decision, the CoA found that ABSENT a logical or valid reason, it could not question how the 1st Respondent raised the cash. All it accepts is that the land was bought by him.

The system detected fraudulent claims that were rejected totalling 11 billion. However, 1.8 billion was paid already and SHA is working on recovery through existing reimbursement & courts

@skinyanjui86@SankeiSaitoti In a country where some police officers have gone rogue and political openly declaring support for different political parties, nothing is impossible. But again, police can be caught in the middle of well planned chaos and the cameras turned to them.
