The Supreme Court in Peter Mbah’s case rejected petition to disqualify Peter on the grounds that he presented a forged NYSC certificate. The reasoning was that, NYSC was not part of the constitutional requirements to run for public office. Let’s even agree for a second that indeed the certificate is forged. It will not constitute a bar to Tinubu’s eligibility to run for office because it’s not one of the requirements to be president. Academic qualifications are what matters.
Also, issues that has to do with qualifications that are brought in pre-election, can only be litigated by members of the political party of the candidate and these members took part in the primaries.
Atiku is a member of ADC and a presidential candidate of ADC. He is not a member of APC and did not participate in its primaries. He does not have the standing to bring an action to disqualify Tinubu. Hiding under constitutional law to avoid the pre election hammer will not save him.
Also, the suit is also statute barred because in pre election cases, plaintiffs have 14 days from the date the candidate is announced the winner to challenge his nomination. Tinubu was announced the presidential candidate of APC in May 2026. Atiku is bringing a suit in August 2026. That’s more than 60 days after primaries had been conducted.
Atiku is as usual repeating the same mistakes of 2023 by fighting a lost legal battle. His loss is guaranteed
