In Bengaluru, a woman is allegedly threatening to kill her 10 years old child and herself.

Police and authorities are not taking action to save the child.

Since last 6 years, the child is with his father. She got him kidnapped from father's house using a goon from Coimbatore. CCTV footage is there.

Now, she has sent a voice message to the child's father threatening that she will kill the child and herself, if he goes to police.

Bengaluru police is delaying in rescuing the traumatised child.

▪️In XXXX v/s State of Karnataka and Anr., Karnataka HC quashed FIR registered against an advocate for rape on the pretext of marriage, holding that the criminal process was being misused as a tool of harassment.

▪️Court observed, “The documents and events noticed hereinabove unmistakably disclose that the complaint is not a genuine criminal grievance, but bears a strong imprint of manipulation and of an attempt to convert private discord into public prosecution.”

▪️The complainant came into contact with the petitioner (a practising advocate) while seeking legal assistance in a matter under NI Act. According to complaint, their interaction later developed into friendship after the petitioner sent her an Instagram request in 2022. The complainant alleged that in July 2023, petitioner promised to marry her and thereafter engaged in repeated sexual relations with her on that assurance.

▪️It was alleged that physical relationship continued for nearly 2 years and that petitioner later began ignoring her calls. The complainant claimed that she subsequently learnt that petitioner’s parents were searching for a girl for his marriage, following which she lodged a complaint on 09.12.2024 alleging rape on the pretext of marriage and also implicated the petitioner’s family members for not supporting the marriage.

▪️Court noted that the complainant was married in 2014 and that the marriage was annulled in 2016. It further noted that a child was born to her in 2020, whose birth certificate mentioned her former husband as the father, indicating continuation of association even after annulment. Court also noticed another birth certificate of 2008 reflecting the birth of another child from a different relationship.

▪️After analysing the complaint, Court observed, “A perusal of the complaint would indicate that even if it is taken at its face value, they were consensual acts for two years, whether on the pretext of marriage or otherwise.”

▪️Accordingly, Karnataka High Court quashed FIR and all consequential proceedings.

▪️Furthermore, Court stated that although the case even warranted examination for malicious prosecution, it restrained itself from issuing such directions.
