As a lawyer with 43 years experience, as someone who has represented Stephen Nkomo, Edward Ndlovu, Sydney Malunga, Kembo Mohadi, Welshman Mabhena, Speaker Jacob Mudenda and many others, as a member of COPAC, I am outraged that a Zimbabwean, who was simply exercising his Constitutional right to peaceful protest against an illegal amendment to our Constitution, is still in detention.
That he is being brought to court in leg irons, like a murderer, makes me apoplectic.
Every lawyer, every magistrate, every judge in Zimbabwe worth his/her salt should be enraged.
This type of treatment should invoke the wrath of the @lawsocietyofzim the @JSCZim and indeed the President (who is a lawyer). This treatment constitutes a deep stain on the reputation of our entire judicial system and Nation.

The debate was organised by the Southern African Times and run in full by The NewsHawks.
Hofisi's work primarily focuses on constitutional law, judicial design, and enforcement of human rights in Africa.
He is currently a Research Fellow at the University of Virginia School of Law and the Karsh Institute of Democracy.
Previously, he was a Hauser Global Fellow at New York University.
Before his academic career in the United States, Hofisi spent seven years as a human rights lawyer with Zimbabwe Lawyers for Human Rights, specialising in constitutional litigation.
So now you are the specialist on this issue because and seem to know when the referendum must apply or not, because of what? Are you a constitutionalist or just acting as a pseudo- constitutionalist/ Pseudo-political commentator or sycophant?
The principal challenge surrounding the CAB3 matter has emerged as the politicization of the discourse, with numerous stakeholders expressing opinions rooted in their own political agendas rather than in objective analysis.
This tactic is regrettable, as it obfuscates understanding for those who might rely on secondary influences to form their perspectives on this issue.
The Constitution explicitly delineates the circumstances under which a referendum is obligatory. Such mandatory referenda are activated by specific provisions that are meticulously outlined. These include Chapter 4, which encompasses the Declaration of Rights; Chapter 16, which governs the regulations pertinent to agricultural land; and Section 328, which delineates the procedures for constitutional amendments.
Provisions that fall outside of these clearly articulated domains do not warrant a referendum.
A referendum is not compelled merely due to the sentiment of a substantial majority or the opposition's belief that the subject matter under consideration is of significant importance. Individual opinions or perceptions regarding a national issue do not justify the initiation of a referendum.
Consequently, the only persuasive argument lies in referencing specific constitutional sections that mandate such a process, rather than resorting to anecdotal moral narratives.
The Constitution is equipped with established mechanisms to address these matters.
The reason why legislative deliberation is entrusted to a select group of 360 individuals, chosen to represent the interests of over 16 million citizens, is to ensure focused and informed decision-making.
These representatives are endowed with the mandate and authority to act on behalf of their constituents throughout their elected term; one cannot selectively acknowledge this responsibility based on convenience during their service.
Current constitutional provisions stipulate that members of Parliament are to engage in deliberation and vote on the proposed amendment.
Should there be dissatisfaction with this process, it would logically indicate that multiple sections of the Constitution still require amendments!
The ruling party has simply exploited a lacuna and the most judicious approach to remedy this situation lies not in advancing disingenuous arguments propelled by emotional appeals, but in recognizing the existing legal structures and seeking correction through established means.
Having failed to incite social unrest and cultivate a negative atmosphere surrounding CAB3, it seems opposition to the bill has assumed a new dimension.
An examination of Hopewellโs statement reveals that some have escalated the dialogue to a point where they are ostensibly attempting to provoke Vice President Chiwenga into intervening to prevent what they perceive to be a grievous infringement of constitutional principles.
According to Hopewell, โthe only person with real leverage inside the system is Vice President General Constantine Chiwenga.
โIf Chiwenga does not act, then these amendments are effectively done.
โThe only institution with the capacity to halt this process is the military. If it does nothing, then the outcome is predeterminedโ.
This here is a naked attempt not just cajoling but calling for an
illegal and undemocratic intervention by the military to interfere and block a clearly democratic process.
Its as shocking as it is the latest indictment how many of the people resisting CAB3 are not doing so out of sincerity but poisoned political objectives.
ZANU PF as a party came up with its resolutions, elevated them to Cabinet which approved and set the ball rolling for the Bill to be presented and displayed for pubic debates.
What is wrong in that chain for someone to shockingly call for the destabilisation of the country by inviting the army to to fight a democratic process?
The nature of democracy is such that as long as the majority who have the power approve then the minority has to accept the situation and
wait to contest the next time around.
Democracy, for good or for
worse, is about numbers. The party that has numbers has control.
No ruling party is in power to advance the wishes of the opposition. Thatโs the practical reality. The opposition should work to resuscitate itself from its current slumber instead of just hitch-hiking on the ruling party's internal affairs.
Now we have people canvassing support for VP
Chiwenga not because of anything he has done but because, โthe reality is as citizens, we have been left with only one alternative, choose which ZANU PF faction is palatable.
This is not just a selfish but dangerous proposition which undressed to its root stands as
the latest revelation of how far the factional agenda, which has
destabilised ZANU PF has gone.
It is now canvassing for support from the opposition to rise against a legitimately elected President!
What proponents of a VP Chiwenga uprising fail to realize is that he remains mainly a military person with little political acumen. This isnโt an insult but a factual reading from his actions.
In his time as VP, unlike others like President Mnangagwa during his own VP days, he has failed or refused to attend many PPC meetings in Mashonaland East, his Province. Thatโs where one begins to take charge, leveraging for the highest seat. ED would attend such meetings in Midlands during his
days as VP!
For one to ascend the ladder of power in ZANU PF they have to build their base from the Province. Even VP Kembo Mohadi attends such
meetings in his own Province.
How then does VP Chiwenga expect to build his political muscle when he doesnโt even try to partake in Provincial activities, building support from there? As it is he mainly derives his power from ED who appointed him as VP. All else people are conjuring are conspiracy theories.
Its thus a very disturbing turn which Hopewell has taken for I have better wishes for him. For someone who has left the country my wish is that he return and if I were the President I would give him Charambaโs job.
Unlike the Deputy Chief Secretary, who has suddenly discovered that there is CAB3 and sought to make corrective amendments with public pronouncements, Hopewell has been frank with his side and views.

He was assaulted while working at a premise in Waterfalls, the Zanupf youths forcibly closed the space and destroyed property.

Takunda Mhuka arrested by Waterfalls police. He went to report that he was assaulted by known ZANU PF youths leaders. Takunda was assaulted while working at our communal business place in Waterfalls. The thugs forcibly closed our communal space and destroyed property. Unfortunately police have arrested him for filing a report of assault and damage to property.
