Section 10 Part II of the Electoral Act, 1992 states that a person is entitled to vote in local elections if he/she is ordinarily resident in Ireland at the qualifying date, in the case of forthcoming local elections, September 2023.
The term 'ordinarily resident' is not defined in the Act. It is, however, defined in our tax laws - Section 820 TCA 1997 which states that if you have been tax resident in Ireland for 3 consecutive tax years, you become ordinarily resident from the beginning of the 4th tax year.
So why is the definition of "ordinarily resident", specifically stated in Irish legislation, not being applied to voting eligibility? Why should it be interpreted any other way, even if not specifically defined in the Electoral Act itself?
The Taoiseach believes that government has automatic power simply to apply a simple requirement to be "resident", applying only the requirement to have a PPS number and eircode, regardless of an individual's nationality.
On what basis and under what authority does the Irish Government claim to act?
Eligibility as regards local elections requires an applicant to be "ordinarily resident at the address applied for on 1st September in the year preceding the year the Register comes into force." It follows that an application for "ordinary residence" cannot & should not be permitted unless the applicant has been "tax resident" for 3 consecutive years, therefore, there is no legal basis on which to permit voting eligibility to Ukrainians or asylum seekers, none of whom are EU citizens.
Of the 27 Member EU States, many countries do not permit non-EU citizens to vote in local elections. Out of those that do, the qualifying criteria for duration of residency varies between 3 & 10 years, with some countries requiring permanent residency.
In the UK & the North of Ireland, voting in local elections is limited to British, Irish, EU & eligible Commonwealth citizens.
There is no basis or authority for the interpretation of 'ordinarily resident' as incorporating all non-nationals merely "residing" in Ireland at the qualifying date.
This will also mean that all asylum seekers & Ukrainians would be eligible to vote & run as candidates in the 2024 local elections. It flies in the face of our Constitution & the rights of Irish citizens to determine their own governance. It could effectively allow asylum seekers & refugees to determine the future of Ireland & its People.
It is time to review the Electoral Act, 1992 to restrict local election voting rights to citizens, like many other European countries, the UK & north of Ireland.
It is time for all TDs & other local representatives to demand answers to these questions.
Why and under what specific authority has the term 'ordinarily resident' in the Electoral Act 1992 been interpreted by Government as requiring no duration of residence for non-nationals, given its defintion under the Taxes Consolidation Act 1997?
Under what legislative authority does the Government claim to act, if not our Taxes Consolidation Act, as regards the definition of "ordinarily resident"?
We could be facing a transformative local government landscape if all non-nationals are eligible to vote & can run as candidates in local elections. Will we find that local politicians abandon the concerns of the indigenous Irish people who kept them in check, secure in the knowledge that they will have the vote of non-nationals? Will this create a conflict of interest and tensions at a local level?
Government must be compelled to answer the crucial questions regarding the motive and authority for their actions, for if they are permitted to continue to implement regulations and policies which are in breach of legislation and repugnant to our Constitution, they will continue to implement same at national and international levels.
The future of our country is at stake.

Irish TD's and Politicians claim they have never received more letters, objections and concerns about a piece of legislation, yet @HMcEntee@LeoVaradkar and all parties are continuing to pursue the new proposed Orwellian #HateSpeech Bill against the wishes of the people.
