@ASFleischman It’s definitely (1), and I’d expand it to include admissibility of evidence too. Based on his comments, he’s getting cooked on admissibility (i.e., not being able to admit prior DV evidence in the DV case, or prior DUI evidence in the DUI case).

Those rules exist for a reason!
