@DielanBB @nftjorge From the interpretation of the draft law, crypto to crypto transactions don't seem to be included under the scope (since they aren't expressly considered). Regarding NFT's, the definition presented for crypto assets is very broad so it seems they should be considered.
Portugal State Budget law proposal foresees the taxation of crypto assets at an individual level at a rate of 28%. Assets held for more than one year are exempt.
State Budget Law will be discussed in parliament during the next 1,5 month and changes enter into place on 2023.
Some questions are still not clear such as:
- Are crypto to crypto operations subject to taxation? At a first glance, since they are not explicitly expressed, they may not be included.

Two proposals were voted:
1. Creation of a reporting mechanism of digital assets above 5.000 EUR and taxation of digital assets.
2. Taxation of capital gains on digital assets.
Both proposals were denied by the majority of the parliament

Portugal should create a friendly tax regime for crypto, what does that mean:
- Fair taxation (not too high, not too low);
- Clarity on the taxation of all types of income (DeFi, NFTs and adaptable to what comes next);
- Simple reporting rules (reporting can't be a nightmare)
Doing this and welcoming the industry with a long term vision and Portugal would position better than 99% of the countries worldwide and still comply with EU and other external pressures.
