The Tribunal is today hearing an interim relief application brought by Openserve (Pty) Ltd and Telkom SA SOC Ltd against Saldanha Bay Municipality.
Openserve is a wholly owned subsidiary of Telkom. Itย builds, owns, operates and maintains physical infrastructure required to provide licenced electronic communications network services.
The application for interim relief concerns access to telecommunications infrastructure in the Saldanha Bay municipal area which includes Vredenburg, Saldanha Bay, Langebaan, St Helena Bay, Paternoster, Hopefield and Jacobs Bay. Openserve and Telkom argue that they are seeking interim relief to prevent imminent, serious and irreparable harm to affected customers and to the competitive process in the Saldanha Bay municipal area, pending the outcome of their complaint to the Competition Commission.
They allege that the Municipality is refusing to allow them to access, maintain, upgrade and/or extend their existing physical telecommunications infrastructure in the municipal area. They argue that this is anti-competitive and unjustified, and contravenes sections 8(1)(b), 8(1)(d)(ii) and 8(1)(c) of the Competition Act. In particular, Openserve and Telkom allege that the Municipality is refusing to give a competitor access to an essential facility when it is economically feasible to do so; refusing to supply scarce products or services to a competitor and/or customer when supplying those products or services is economically feasible; and/or engaging in the exclusionary act of preventing Openserve from participating and competing effectively in the fixed network operator market in the Saldanha Bay municipal area.
They further allege that the Municipality is pursuing a strategy to create and entrench a monopoly for Zoom Fibre (Pty) Ltd (โZoomโ) in the fixed network operator market within the Saldanha Bay municipal area, noting that the Municipality has appointed Zoom as its fibre partner through Amoeba Mobile Solutions (Pty) Ltd.
Pending the final determination of their complaint, or for a period of six months (whichever occurs first), Openserve and Telkom seek an interim order from the Tribunal:
- interdicting the Municipality from preventing them from accessing, maintaining, replacing, upgrading and/or extending their physical telecommunications infrastructure within the municipal area; and
- requiring the Municipality to immediately grant and issue wayleaves for four applications. (A wayleave is a legal agreement or permit that allows a third party - such as a utility company, council or telecommunications provider - to access, install and maintain infrastructure on or under public or private land).
