Section 87A Rebate on STCG under Section 111A – ITAT Bangalore Allows It

Facts: The assessee, an individual, filed a return showing short-term capital gains under Section 111A.

The CPC processed the return but denied the rebate under Section 87A, taking the position that capital gains taxable at a special rate are not eligible for the rebate. The CIT(A) upheld the CPC denial. The assessee appealed to the ITAT Bangalore.

ITAT Held: The #ITAT allowed the #appeal, holding that Section 87A rebate is available on total income irrespective of the rate at which any component is taxable.

It noted that Section 112A expressly restricts rebate for gains under that section, but Section 111A has no such restriction. The Finance Act 2025 amendment (which would deny rebate on 111A gains) is prospective. The rebate claim was valid, and the consequential demand was deleted.
