Attention BC criminal counsel: we successfully challenged ss. 742.1(c) and (e)(ii) this morning (provisions limiting the availability of CSOs). Schultes J. found these provisions to be overbroad, consistent with the majority ruling in R. v. Sharma, 2020 ONCA 478.
