Land Tenure Conversion And When to Raise an Issue Regarding the Cause of Action?
Yesterday, the Principal Judge delivered a decision addressing the question of "When to Raise an Issue Regarding the Cause of Action?" The judge held that this issue is only relevant when the plaint raises concerns under Order 7 Rule 11(a) of the Civil Procedure Rules, which empowers the court to reject a plaint that fails to disclose a cause of action.
Citing the decision of the Court of Appeal in Kapeka Coffee Works Ltd v NPART CACA No. 3/2000 which has established that in determining whether a plaint discloses a cause of action, the court must solely consider the plaint and its annexures, if any, and no other evidence.
This issue would have been crucial if the rejection of the plaint for failure to disclose a cause of action was in question. Therefore, the cause of action is determined exclusively by examining the plaint or its annexures, without considering any other evidence.
In the same decision, Justice Flavian Zeija also determined that the conversion of the suit land from mailo tenure to freehold tenure was legally and properly done.
The justice found that the conversion was done in accordance with the laws governing land conveyancing at the time, and there is no evidence to suggest that the freehold tenure was later changed.
Moreover, the court discovered that the original mailo title, which should be in the custody of the Registrar of Titles, was in the possession of the plaintiffs, which is a criminal offense.
The justice confiscated the title and ordered it to be returned to the Registrar of Titles. The court also recommended that the matter be investigated by the Criminal Investigations Department for possible prosecution of all perpetrators.

We better focus on expanding & protecting the hunting grounds. The clearing agents do it so well. You can't clear goods on your own, URA protects them.
