Most Respectfully Showeth:
That the applicant is a law-abiding citizen and resident of the address mentioned above and is filing the present application being aggrieved by the order dated 01.04.2026 passed by the Learned Sub-Divisional Magistrate, Lalganj.
That the impugned order has been passed in Case No.116 under relevant provisions, without proper appreciation of facts and evidence on record.
That the applicant is the co-sharer and is in lawful possession of his share in Gata No. 327 and related property, as per family partition.
That the applicant has already raised construction within his own share, strictly in accordance with his legal rights.
That the opposite parties, particularly Rajesh Singh, have been illegally interfering and creating obstruction in the peaceful possession and construction of the applicant.
That the applicant had approached the authorities earlier, but the same has not been adequately considered.
That the Learned Sub-Divisional Magistrate failed to consider the relevant documents, factual position, and submissions made by the applicant.
That the impugned order is arbitrary, one-sided, and against the settled principles of natural justice.
That the order has caused serious prejudice, hardship, and irreparable loss to the applicant.
That as per the findings/observations recorded in Point No. 10 of the impugned order itself, the matter requires proper adjudication and maintenance of appropriate status; however, the same has not been properly enforced, thereby resulting in miscarriage of justice.
That the impugned order is liable to be set aside/modified in the interest of justice.
PRAYER
It is, therefore, most respectfully prayed that this Hon’ble Authority may graciously be pleased to:
a) Call for the entire record of the case;
b) Set aside / modify the impugned order dated 01.04.2026 passed by the Sub-Divisional Magistrate, Lalganj;
c) Provide an opportunity of hearing to the applicant;
d) Pass any other order deemed fit and proper in the interest of justice.
