Latest update in Grandfalls - it seems they now have some sort of contraption that is cemented into hole and they’re simply pumping the water into frac tanks. But the entire block is soggy. Not clear what the plan is to stop the flow at depth.
This is Texas under the GOP. A west Texas Wellhead has been blown out for years, creating a highly toxic lake ( Lake Boehmer). The toxic water is from fracking in nearby wells. The Texas Railroad Commission refuses to do anything about it. #txlege
How much money is being pumped into data centers in the Permian? Are they building them on top of old “plugged” wells? How much does it cost to relocate servers when one of those wells starts leaking? Ask the First Baptist Church in Grandfalls how that’s going for them. Follow me on @zombiewellz if you want updates.
Checking in for Fifth Circuit argument in Houston (riding the circuit for real!). And today, I am second chair to the excellent Hannah Crow, who is handling the argument.
Thank you to @Law360 for covering the filing of our lawsuit. @BurnsCharest for the plaintiff.

Great end to 2025 with an appellate win for @BurnsCharest clients in Upstream Harvey. The Federal Circuit affirmed the liability trial completely and, with minor issues in both directions, affirmed the compensation trial. We will push forward in 2026!

This past weekend, I visited my friend @Sarah4Texas at the beautiful Antina Ranch in West Texas.
The 22,000-acre family ranch is breathtaking, but it's facing some real challenges. Old, abandoned, and “plugged” wells on the property are showing signs of big trouble — leaking oil and building pressure that shouldn't be there. There is certainly an unknown effect of contaminated groundwater, making parts of the ranch no longer safe for cattle. Leaving a family legacy built over generations, now facing an uncertain future.
Antina Ranch's experience exposes gaps in the regulatory system, which have contributed to their problems. @KingForTexas , @toddahunter and @Burrows4TX for Texas heard similar concerns from honest, outspoken ranchers related to the breakdowns at the Railroad Commission and the PUC during the Panhandle Wildfires.
Rural landowners are often overlooked or given the run around when it comes to working with the big government agencies. That needs to change. And as #conservatives, we should be critical of our government, especially when it is not protecting our interests from big industry.
There is an important story here to be told — not just for Antina Ranch, but for landowners across rural Texas. Look for it soon in the Texas Rural Reporter.
