STATEMENT ON CONTRADICTING HIGH COURT DECISIONS ON THE DATE OF ELECTIONS - HIGH COURT CONSTITUTIONAL PETITION NO. 368 OF 2018

Fellow Kenyans,
In my continuous pursuit to uphold constitutionalism and strict adherence to the law, I filed a petition in 2018 alongside Nyakina Wycliffe Gisebe against the Attorney General and the Independent Electoral and Boundaries Commission (IEBC). Our position then was, based on a calculation of time under Article 101(1) and related provisions, the correct date for the general election ought to have fallen in August 2021 specifically, four years after the 2017 elections, rather than pushing it to 2022.
On 26th November 2020, the High Court (Hon. Justice Weldon Korir) dismissed our petition with costs. It is important for the public to understand the clear judicial reasoning given by the court for this determination:

Constitutional Harmony & Full 5-Year Tenure:
Justice Korir highlighted that the Constitution mandates that all elected officials (the President, Governors, MPs, and MCAs) serve a full five-year term and be elected on the exact same date. Accepting my interpretation would have truncated the terms of sitting elected officials down to four years, producing an absurdity that goes against a holistic and purposive interpretation of the Constitution.

Computation of Time:
Relying on Article 259(5)(c) and binding Court of Appeal precedent (Attorney-General & another v Andrew Kiplimo Sang Muge & 2 others), the Court affirmed that a 5-year cycle counted from the August 8, 2017 election ends on the second Tuesday of August in the fifth year—which firmly established the next general election date as 9th August 2022.

Precedent and Futile Litigation:
The learned judge noted that the legal question regarding the election cycle had already been authoritatively determined by the Court of Appeal in November 2017, nearly a year before my petition was lodged. Consequently, the High Court held that litigating settled law caused unnecessary expense to taxpayers, warranting an award of costs against the petitioners.
While I took a different legal view at the time, I respect the rule of law and the constitutional boundaries set by the courts.
True public interest litigation requires pushing the boundaries of legal interpretation, accepting judicial rulings gracefully when established precedent prevails, and continuing to defend the Constitution within the parameters set by our judicial system.

According to the High Court’s reading of the Constitution, Ruto should be facing Kenyans at the ballot next Tuesday, not enjoying another comfortable year in State House.

So from August 11, the real question becomes whether Kenya is being governed by a President whose electoral lease has technically expired under that interpretation.

The court suspended the effect of its declaration pending appeals, meaning Ruto remains legally in office for now, but the judgment has opened a serious constitutional fight over whether his mandate truly runs all the way to August 2027.

The High Court in Malindi has ruled that Kenya's next General Election ought to be held in August 2026, not 2027.

The court based its decision on the Constitution, which says elections should be held on the second Tuesday in August in every fifth year.

According to the ruling, "every fifth year" means the election should take place during the fifth year after the last General Election, not after five full years have passed.

Since the last General Election was held on 9 August 2022, the court says the fifth year falls in August 2026, making that the correct election period.

The court also found that holding the election in August 2027 would not comply with this interpretation of the Constitution.

However, the court suspended the effect of its decision because organizing a nationwide election in August 2026 is no longer practical.

This means the ruling does not immediately change the current election timeline.

The decision is expected to be appealed, so higher courts could still determine whether Kenya's next General Election will be held in 2026 or 2027.

🚨Cooking oil is back to Sh358 per litre, the highest price since the 2022 crisis.

That's just Sh22 below the painful peak of Sh379. Only a few months ago, it was Sh343. Now we're right back in the fire.

Meanwhile, the govt keeps insisting the cost of living has gone down and they want 5 more years.

NTSA has continued arresting Kenyans for failing to use footbridges. Today alone, they arrested over 30 people.🚨

I support road safety, and I appreciate the enforcement.

But can we also ensure the footbridges themselves are usable?

Many have become:
- Hotspots for thieves who prey on pedestrians.
- Makeshift markets where people, and even motorcycles, operate freely.
- Public toilets, with the smell of urine and faecal matter in some sections.

You can't force people to use infrastructure that feels unsafe, dirty, and chaotic.

Fix the bridges first, remove the thieves, clear the markets, and clean them properly, then enforce the law. I know some people might disagree with me on this but its important.

HISTORIC VICTORY. HIGH COURT DECLARES THERE IS NO TIME LIMIT ON LAND JUSTICE IN KENYA.

In my petition, Okiya Omtatah Okoiti v Attorney General & Others, the High Court has declared unconstitutional the provisions of the National Land Commission Act that imposed time limits on the Commission’s constitutional mandate to review grants of public land and investigate historical land injustices.

The Court affirmed a simple but powerful principle. Parliament cannot diminish or extinguish powers that the Constitution has vested in an independent constitutional commission. Justice delayed cannot become justice denied through legislative deadlines.

This judgment restores hope to thousands of Kenyans and communities who were locked out of justice by arbitrary statutory time bars. The constitutional path to redress for historical land injustices remains open.

The Constitution has prevailed. Land justice has no expiry date.
