Victor N. (42) gibt an, mehrere Wochen in den Niederlanden Urlaub gemacht zu haben. Er legt den Beamten italienische Asylpapiere vor.

Die Beamten prüfen die Daten: Einreisesperre für Belgien wegen Drogenkriminalität.

Ein Schnelltest weist Kokain an seinen Händen nach. Dann geht es nach Kleve ins Krankenhaus. Ein CT zeigt mehrere "Bubbles" mit mutmaßlich drei Kilo Kokain im Dickdarm des Mannes.

Die Polizei beantragt Untersuchungshaft, doch die zuständige Richterin lehnt das ab, lässt den Nigerianer laufen.

Grund:

Man weiß ja nicht, ob wirklich Kokain in den Bubbles ist. Die Spuren an den Händen kommen wohl vom Eigenkonsum. Fluchtgefahr besteht nicht, weil er ja eine Duldung in Italien hat. Präventivhaft kommt auch nicht in Frage, da die eventuell vorhandenen Drogen ja bereits eingeführt wurden.

"Die bloße theoretische Annahme, dass der Beschuldigte die Betäubungsmittel nach einer späteren Ausscheidung weiterverkaufen könnte, reicht für die Prognose einer unmittelbar bevorstehenden Straftat von erheblicher Bedeutung nicht aus.

Auf ausdrückliche Anordnung der Richterin wurde der 42-Jährige entlassen."

Victor N. verließ das Krankenhaus als freier Mann. Die Bubbles (Marktwert ca. 60.000 Euro) hat er da immer noch im Körper. Die Weiterreise wurde ihm gemäß Gerichtsbeschluss gestattet.

Die Staatsanwaltschaft legte Beschwerde ein, die Richterin wollte bisher keine Stellungnahme abgeben.

Man kann also festhalten: Solange man die im Körper verpackten und geschmuggelten (mutmaßlichen) Drogen nicht freiwillig herzeigt und nicht akut fliehen will, ist alles in Ordnung, auch wenn alles auf Drogenkriminalität hinweist, ja?

Fatale Signalwirkung und eine Torpedierung der Grenzkontrollen.

Es muss unglaublich frustrierend sein für die Beamten 😡
