The President of Somaliland also expressed his gratitude to @SenTedCruz for his letter to President Trump urging recognition of Somaliland. In addition, he thanked @RepScottPerry for introducing the Somaliland Recognition Act.

Government of the Republic of Somaliland Reaffirms Its Sovereign Authority and Legal Position Regarding Dr. Markus Hoehne
Hargeisa, Republic of Somaliland
The Government of the Republic of Somaliland takes note of the recent conclusion of legal proceedings in the United Kingdom. The Government was not a party to those proceedings and therefore will not comment on the terms of any private settlement reached between the individuals concerned.
The Government nevertheless reaffirms its sovereign authority over all matters relating to its domestic legal, immigration, and border policies. Such decisions are made exclusively in accordance with the laws of the Republic of Somaliland and remain solely within the jurisdiction of its competent national institutions.
Dr. Markus Hoehne was deported from the Republic of Somaliland following documented concerns relating to the alleged abuse and exploitation of young girls. The Government determined that the circumstances warranted his immediate removal as an administrative measure to protect public order, public safety, and vulnerable members of society. That decision remains fully in force and has neither been rescinded nor withdrawn.
Should Dr. Markus Hoehne seek to re-enter the Republic of Somaliland at any time, he will be subject to the full application of Somaliland law. The Government will enforce all existing legal and administrative decisions and will take any lawful measures available under Somaliland law, including detention where legally justified and the initiation of any appropriate legal proceedings arising from the matters that led to his deportation.
The Government further notes that, since 2023, Dr. Hoehne has maintained a significant public presence on various social media platforms, where he has published commentary concerning Somaliland, its government, and its citizens, including allegations that the Government categorically rejects as false, misleading, and defamatory. The Government also observes that this period of public commentary has coincided with longstanding public discussions and scrutiny concerning aspects of Dr. Hoehne’s academic work, research methodology, and professional conduct, matters that have attracted criticism and debate over a number of years.
The Republic of Somaliland remains steadfast in its commitment to protecting vulnerable members of society, upholding the rule of law, defending its sovereignty, and safeguarding the dignity and reputation of its people and institutions against false and defamatory allegations. The Government will continue to act firmly and in accordance with the law to protect the rights, security, and interests of the Republic of Somaliland and its citizens.

❌ Why the 1961 “Act of Union” Between Somaliland and the Republic of Somalia Fails to Meet International Legal Standards
The 1961 Atto di Unione, passed by the Mogadishu-based parliament, aimed to formalize a union between the independent State of Somaliland and the Republic of Somalia. However, from the perspective of international law, this union failed to meet the required conditions for a lawful, de jure merger of sovereign states.

🛑 1. No Bilateral Ratification
Requirement: Both sovereign states must ratify a union law through their legitimate legislative or constitutional bodies.
Failure:
•The “Act of Union” was passed unilaterally by the National Assembly of the Republic of Somalia in January 1961.
•The State of Somaliland had passed its own version of a union bill in June 1960, but this was never legally harmonized or jointly ratified.
•The two acts had different wording and legal frameworks.

Requirement: Sovereign states must sign a mutual treaty of union, recognized under international law.
Failure:
•There was no treaty signed between the two sovereign governments.

Requirement: Union must be legally enacted before or at the moment of merger—not retroactively.
Failure:
•The Atto di Unione was passed on 31 January 1961, but claimed to take effect retroactively from 1 July 1960—a full seven months later.
•By that time, Somaliland had been already annexed its institutions dissolved without any legally binding agreement in place.

Requirement: The people of both states must consent, especially in cases involving sovereignty transfer.
Failure:
•A 1961 referendum on the new Republic Somalia constitution was widely rejected in Somaliland and marred by boycott and irregularities.
•Popular legitimacy, a cornerstone of international law and the UN Charter (Article 1(2)), was absent.

🛑 5. Inequality in Union Structure
Requirement: States in a union must retain equality and sovereign dignity, especially when both were internationally recognized.
Failure:
•The union treated Somaliland as absorbed into the pre-existing framework of the Republic of Somalia.
•Mogadishu became the capital, Somali law was imposed, and all pre-existing Somaliland structures were dissolved.
•No parity or federal balance was ensured.
➡️ This contradicts the sovereign equality of states, a principle enshrined in the UN Charter (Article 2(1)).

🧾 Summary
The Republic of Somalia, which was admitted into the United Nations on 20 September 1960 (UNGA Res. 1479 XV), acted unilaterally to formalize a union that was not mutually ratified, not based on treaty, and not consented to by the people of Somaliland.
Under international law, the union was defective from the beginning:

•❌ No joint legislation
•❌ No referendum legitimacy
•❌ Retroactive application
•❌ Unequal structure
This opens the door for Somaliland’s legal argument: that no valid de jure union ever occurred—making its original sovereignty intact and restorable under international law.
