A new Congressional Research Service analysis says roughly 13% of employers filing LCAs identified as H-1B dependent or willful violators from FY2022-24.

But fewer than 1% said they were actually required to follow the additional attestations.

Why?

One exemption is tied to a $60,000 salary threshold created in 1998.

It has never been adjusted for inflation.

Twenty-eight years later, we’re still using $60,000.

What would that threshold be today if Congress had simply indexed it to inflation?
