I'm tapping into a real and growing sentiment in parts of South African political discourse. Frustration with judicial review, constitutional supremacy, and so-called "activist" courts. That frustration has pushed some voices to call for stronger parliamentary sovereignty, closer to the UK model where Parliament is supreme and courts have limited power to strike down laws.

This view often comes from critics on the left. They argue that the Constitution and the courts act as a brake on radical economic transformation, land reform, and majoritarian policies. In their telling, judicial oversight, whether striking down legislation or reviewing executive action, undermines democracy. It lets unelected judges override the will of the people as expressed through Parliament. They also feel that commissions of inquiry and Chapter 9 institutions can turn into unelected parallel structures that dilute Parliament's primacy.

Look at the record. We've seen the Constitutional Court called a "roadblock." We've heard calls to amend the Constitution to rein in judicial power. We've heard arguments that Parliament should have the final say on the big socio-economic questions. With the political realignments unfolding, like the GNU dynamics after the 2024 elections, these tensions between the courts and Parliament aren't going anywhere.

In the Andrea Johnson and the @NPA_Prosecutes saga, the Madlanga Commission's deeper scrutiny, when set against Parliament's committee, shows exactly why some of us prefer constitutional tools. They can deliver more rigorous, less partisan accountability. Of course, others see that as the very problem: unelected processes overriding elected bodies.

I know where I stand. I am happier in the hands of the courts. Parliamentarians have led us down. #PhalaPhalaFarmGate is a classic example.
