1. In Kenya, the HIV and AIDS Prevention and Control Act (HAPCA) and MOH clinical protocols prioritize patient confidentiality. Because HIV results are "sensitive information" (Section 22), clinics rarely hand out physical lab reports to avoid accidental disclosure and stigma.
2. Instead, patients who test positive are immediately enrolled into the Comprehensive Care Centre (CCC). Their proof of status is their MOH 258 Patient Appointment Card (the yellow card) and their entry in the national Electronic Medical Records (EMR) now the TAIFA CARE. This is the standard of care across the country.
3. Demanding an initial lab report years later ignores these real-world protocols. For a patient who has been on ART for a year and EXISTS in the ART register and in Taifa Care, the MOH 258 form is their official legal and clinical record. The HIV and AIDS Tribunal exists specifically to protect such patients from being penalized for the way our health system operates.
4. Science must respect clinical reality. If a patient was enrolled in care and has been on ART, they met the diagnostic criteria at the time. Using current NEGATIVE results to invalidate their history—without acknowledging that our system doesn't issue reports—undermines both the law and the patient’s rights.
It totters on the brink of falsehood.
