STATEMENT BY HON. DR. @unitydow on GBV motion followed by a PETITION:

Today I visited 3 Courts to enquire about the GBV Desks and Rooms that the Minister of Justice said were in place.

🔸Village Magistrate Court -
1. They do not assist walk-ins.
2.Victims must go to police first before they can be assisted.
3.They hear GBV cases on Mondays and Wednesdays only and only in the mornings.
4. To quote the officer "re utlwile ko Palamenteng mo radiong, mme ga ise go diragadiwe".

🔸Broadhurst Magistrate Court
1.They have a walk-in service.
2.Victims are assisted on Mondays and Thursdays only and only in the mornings.
3.The security will not allow victims to go into the court building on days other than the specified days.
4. There are no dedicated officers dealing with GBV cases.
5. To quote an officer " ga a tla o tsile go thusiwa ke mongwe le mongwe...re dira di restraining orders"

🔸Mochudi Magistrate Court.
1. They assist walk-ins.
2.They assist on Monday to Thursday. Mornings only.
3.There are no dedicated GBV staff.

None of the courts use Section 335 of the CP&E.

None of the courts have dedicated offices or rooms as announced in parliament.

None of the courts have dedicated staff to assist GBV victims.

To offer better and adequate services, the justice system clearly needs to be better resourced.

The use of Section 335 of the Criminal Procedure and Evidence Act is not incompatible with the application of The Domestic Violence Act. The two can be employed together.
