You're potential violation of federal and state anti-discrimination laws, as well as Delta Air Lines' own customer service policies, as evidenced by the recent removal of an elderly passenger from a flight for wearing a MAGA hat.
Specific Concerns:
1. Discrimination Based on Political Expression:
The removal of the passenger for wearing a MAGA hat appears to be discrimination based on political affiliation, prohibited under Title VI of the Civil Rights Act of 1964. This contradicts Delta's commitment to being an "anti-racist, anti-discrimination global airline," as stated in your Diversity, Equity & Inclusion policy, which emphasizes respecting and reflecting the world to better serve global customers.
2. Violation of Customer Service Plan and Contract of Carriage:
Delta's Customer Service Plan commits to ensuring a comprehensive customer service experience and protecting customer rights, including providing refunds within 7 business days for credit card purchases and within 20 days for other forms of payment.
The Contract of Carriage states that Delta shall not refuse transportation based on assumptions about a passenger's needs or attire, provided the passenger is self-reliant. The removal of the passenger without due process or justification breaches these commitments.
Demand for Action:
*A full investigation and disciplinary measures against the involved employees.
**A public apology and reimbursement of all affected passengers' expenses within the specified refund timelines.
*** The immediate termination of Delta's DEI program, in alignment with the Trump administration's directives to end such initiatives, to prevent further incidents of discriminatory practice.
