@catturd2 Breaking into your "detached garaged". Not recognized as part of the home in Michigan. It does not do anyone any good to frame this so cut and dry, but @Catturd can only profit of sensationalism. Shooting at fleeing perps is also not a legal claim for self-defense.
@XxBallSnackxX@NatCon2022 They didn't come in to the "house". It was a detached garage, not recognized as part of the home under self-defense in Michigan. I don't care how many times people conflate these two, the law is clear on this, hence the charges.
@lordvictor Except Michigan law doesn't recognized a detached garage (which it was in this case) as grounds for an imminent threat of bodily harm. This and the fact that he shot at fleeing perpetrators is why he is being prosecuted. Just FYI there
@ja78519@hayasaka_aryan No, you really don't. Education is a key component to firearms safety and clearly there are massive gaps in knowledge when it comes to how to legally and illegally apply deadly force.
@RichardMortimir@hayasaka_aryan You do a disservice to your argument and yourself by making it about race. Criminals come in all shapes, colors and sizes. Nothing like a sweeping generalization to make you seem intelligent.
@Tom90694@hayasaka_aryan There is no "duty to retreat" in Michigan under castle doctrine, correct. But, and this is WHY it is so important to know and understand the law, "Applicable locations: The law applies to your home, an attached garage, business premises, or any occupied vehicle."
@Product_007@Rightanglenews Almost like we have a legal system designed to sort these types of things out. No one is saying it's perfect, but it is almost never cut and dry.
@aquiloniandream@cashbeking@Rightanglenews Did you really just use the Joker movie as the basis for your argument? Now that is delusional. Thank God you aren't a judge.
@aquiloniandream@Rightanglenews Your argument has no basis in reality. The criminals in this case weren't even made aware of the homeowners presence until he started firing at them through a garage window. Once they tried to flee, he continued to shoot. That is attempted manslaughter, agree or not.
