Question: There have been many Start-Up Visa refusals based on the ground that Commitment Certificates were not received by IRCC from the Designated Entities at the time of application submission. What is the regulatory authority for this?
Answer: While Canadian immigration legislation does not specifiy a timeline for when the Commitment Certificate must be received, IRCC's operational guidelines fill that gap. It is this procedural requirement, rather than a strict wording of Canadian immigration legislation, which forms the basis for refusals.
