There is a big difference between having the jurisdiction (the legal right) to review a case and finding the substantive grounds to actually overturn it.
Here is a scenario, if you steal from your employer, and he fires you without following procedure...it doesnt change the fact that you stole.
You can be compensated because procedure wasn't followed, but you cannot sue to get the job back.
Rigathi challenged the reasons for impeachment and failed, so he challenged the process.
But a flawed process does not change material fact.
After thinking about it, I find the judgement on Gachagua reasonable;
Think about it, Gachagua was impeached by both National Assembly and Senate.
Those two houses are meant to uphold the will of the people.
So the courts were pragmatic in that, they upheld the will of the people and recognized that Gachagua's rights were violated.
So instead of complaining, vote better next time for your MPs and Senators.
The Judiciary could only stop it before it got to Senate. The Senate is a quasi judicial body and a representative body. Once it rubber stamps something, its hard to rescind.
That is why the Judiciary said, ni sawa, your rights were denied, but there is nothing that can be done at this point.
