PRESS STATEMENT BY SENATOR OKIYA OMTATAH ON THE PUBLIC DEBT CASE RULING

Fellow Kenyans,

Today, the High Court delivered an important ruling in our public debt case.

The Court upheld the @IMFNews claim of diplomatic immunity and struck it out of this petition. While we respect the Court’s decision, accountability for Kenya’s debt burden cannot end there.
We are preparing a separate legal challenge to the Bretton Woods Agreements Act, 1963, against the Constitution of Kenya 2010 to ensure all actors involved in Kenya’s debt processes are subjected to proper scrutiny.

Most importantly, the Court rejected attempts by the Attorney General and other respondents to have this case dismissed. The judges ruled that our petition will proceed to a full hearing on its merits.

The Court also dismissed applications by the former Auditor General, former Controller of Budget, the current Auditor General, and the current Controller of Budget seeking to shield themselves from these proceedings.

This is a significant victory for transparency, accountability, and the Kenyan people.

We will amend our petition as directed by the Court and return on 22nd July 2026. Our mission remains unchanged: to establish how Kenya accumulated trillions in public debt, how the funds were utilized , whether the public benefited and whether the law was followed at every stage.

This case is about protecting the future of our nation and the interests of every Kenyan taxpayer.
We remain focused, determined, and committed to seeing it through.

One day, Kiraitu Murungi, then Minister for Justice and Constitutional Affairs, and President Mwai Kibaki were driving around and some boys showed up in the road and asked them to give them some little cash.

Kiraitu dipped his hand in his pocket and before he could extract the money, Kibaki asked him:

'Bwana Waziri, what are you trying to do?'

'Why should these people be given money?

What have they done? Don't they have farms to till or cows to feed?

Who invited them to come and stare at our motorcade?

Surely, must we just be paying people for standing by the roadside?'

Upon ascending to power, Kibaki never participated in any harambee because he believed that it was better to grow the economy than to dish hand-outs.

When a delegation from Nyeri went to him to ask for favours in terms of funding after the 2002 polls, the president told them, without blinking an eyelid, that banks in Kenya have things called loans which one could apply for and that State House was not licensed by Central Bank to offer credit.

We hope that one day, Ruto will love Kenya more than he love himself. That he will seek to win for Kenya more than he wants to win for himself.

At this moment, everything Ruto has done, was in the furtherance of his own ambitions and wealth, not those of Kenyans.

The affordable housing projects are done because they are markets for his cement, steel and poles. He is earning double, from the housing levy and the building materials sale.

Single government payments through E-Citizen was pushed to benefit his bank Sidian. Even then, Auditor General has told us how Billions collected through E-Citizen could not be traced.

He sold Kenya Pipeline to himself and the government has refused to make that information public. He has made billions in G-to-G deal.

SHA has his fingerprints everywhere. Kenyans caught them stealing through ghost hospitals and since then, they stopped releasing SHA disbursement data.

He is currently clearing Kenyan forests under the guise of building state lodges when the real deal is he is doing so to get raw materials for his furniture company, then sell the furniture back to his government, inside trading.

We now have the JKIA deal where insiders tell us that him, his wife, and their beloved friend Chivayo have stake in the airport renovation project where the costs has been inflated by more than Kshs 150 billion, just to accommodate their interests.

No nation can prosper when its leader has a personal ambition to be the richest man on earth, and doing so from the sweat of its citizens.

The greed of the UDA administration and its leader, is an existential threat that we Kenyans must do everything possible to save our nation from.

2027 is about one thing, Patriotic Citizens rising to save their nation that is on the verge of extinction.

UDA Must be WanTam.
