I wouldn’t have pursued a malpractice lawsuit 14 years ago if the MD would have told me directly on the day that my baby daughter in the NICU had a respiratory arrest for 10 min after a dose of fentanyl. Instead I was told on the day of the event she was intubated as a precaution. One month later I was told she had a brain injury likely due to hypoxia but they couldn’t tell me exactly when or pinpointed an event during her NICU stay. The MD just said, “ you have to keep in mind she was a sick baby”

Fast forward 6 months I ordered the medical records. Combing through 1500 pages I found the nursing note of that day… “respiratory arrest with fentanyl , narcan given, vigorous intervention for 10 min”.

Seeing that made me question what else were they hiding. I found a notation of the fentanyl dosage calculation and it looked off by one decimal place as compared to subsequent doses. We alleged that the nurse made a dosing error.

If on the day of the event, the MD just said, “we gave your baby some pain meds and she had a bad reaction and we needed to intubate her” I probably would have never questioned it. Then the following conversation on the hypoxia and brain injury would have been difficult but understandable.

Instead I ended up goin down the path thinking what are they hiding and the why must be because they screwed up and I need to sue for malpractice.
