@JoanBiskupic Did you notice that no Justice asked about what provision of the Constitution gives President Trump (rather than Congress) the power to interpret the 14th Amendment usually reserved to the Court?

Multiple questions and answers addressed what Congress could do with its power  to “enforce, by appropriate legislation” the provisions of the 14th Amendment including birthright citizenship.

Does this mean the Justices have likely  already decided that the President does have such power from somewhere undiscussed, or that he does not --  and that the case is essentially over regardless of the arguments about what Congress could do?

Aren’t questions of separation of powers (which Kavanaugh briefly alluded  to). pretty darn important to deciding on the Constitution legitimacy of an Executive Order?

Does that mean they already agree with Trump's opponent that the Constitution's separation or powers means only Congress can do so, if at all?

@SaraEisen President Trump already has a press spokesperson...your ignorance of the US Constitution and law is showing: Congress only declares war and has made one exception for the President to take military action against "imminent" threats -- unless we are in Orwell-land, that means like "now." Even before that law was passed, FDR in 1941 had every reason to act militarily right after Pearl Harbor...but unlike Trump he chose to trust (and thus) trust the American people's representatives by going to Congress (which you seem to think is irrelevant now). Please just be careful opining on law you haven't studied -- your opinions matter and are usually more considered .

Then would the Fed cut in Dec? Market senses jobs picture worse than Fed sees..traders have college grad kids who can't find work...

@DouthatNYT re your newsletter comment that Trump's expression of hate for his opponent in front of Charlie Kirk's grieving widow: IMHO it was not "funny in a Trumpian Way" -- any more than Jimmy Kimmell's comments that offended so many...But I agree with you that Trump spoke the truth about his hate -- yet Charlie Kirk put that i unChristian fact aside and enabled his Presidency -- probably put him over the top. Kirk said some hateful things, too (black women lack sugffienct mental capacity, MLK was an awful person.... and in a neat rhetorical trick, marketed "Prove me Wrong" as evidence of his bravery, good-heartedness and support of unfettered free speech. But his phrasing is in fact a subtle and too-clever way of shifting the BURDEN of PROOF in any debate to whoever dares disagree with Charlie Kirk. Nice work if you can get it. His assassination is rightly considered clear evidence of evil in this world. But there are other evils -- including his view that some number of innocent children's deaths are an acceptable price to preserve the Second Amendment (as he defines its meaning). As a Christian, I beg to disagree: prove me wrong?

FACT: The last job report before the election issued in October 2024 showed job growth of only 12,000, and revised the figures for the prior two months downward significantly! (Sort of like what Trump is complaining happened to "him" today!)One of the more blatantly incoherent conspiracy theories of all time. As always, believe Trump at your peril.
