Pre-nups can raise thorny issues. Exploring these within mediation may be more conducive for some as opposed to a to and fro with lawyers. The lawyers can then incorporate what has been agreed within the Agreement.
We advise clients to consider alternative dispute resolution on relationship breakdown as a matter of course, but could we do more to promote mediation to clients who are considering a pre-nup/ cohab agreement at the inception of their relationship? Food for thought!
