Observation:
If you are a potential member of a class of plaintiffs in a possible class action suit, you need to read carefully any "Engagement Agreement" with an attorney that you are told you must sign.
Oftentimes there is a provision that is included but not explained which will obligate you to pay a portion of any money you are awarded over to that attorney if that attorney ends up not being part of the action that leads to you being paid as a class member.
This is called "quantum meruit." It means you agree to pay that attorney for the time he spent if he ends up not being part of the lawsuit that is ultimately filed -- and you end up getting an award from a class action suit brought by a different attorney.
There is no requirement to sign an engagement agreement to be included in a class action. If the Court certifies the class, every person who fits the description of the class must be contacted and given an opportunity to be included -- regardless of whether you signed an engagement agreement.
The engagement agreement is a way for the lawyer to claim some of your recovery if the lawyer doesn't end up participating in the case.
So, if you are ever solicited to join a class action and are told you need to sign an engagement letter with a particular lawyer to do so, that engagement agreement is for the benfit of the lawyer, not you.
