A Florida judge is reminding Gov. Ron DeSantis that, uh, the First Amendment exists.

The governor had the Florida Department of Health issue a cease and desist letter to TV stations in the state that aired ads supporting the state’s referendum that protects abortion rights that Florida citizens will vote on in November.

In turn, Chief U.S. District Judge Mark E. Walker granted a temporary restraining order against the state’s surgeon general for threatening to prosecute any of the TV stations that air the pro-choice ads.

‘Political advertisement is political speech — speech at the core of the First Amendment,’ the judge wrote. ‘The government cannot excuse its indirect censorship of political speech simply by declaring the disfavored speech is 'false.’’

And then also, hit ‘em with this absolute zinger: ‘To keep it simple for the State of Florida: it's the First Amendment, stupid.’
