If you are watching the obvious replacement of American workers with H-1B labor in your office, here is how to protect yourself.

Document everything.

Keep detailed, factual notes:

Dates
Meetings
Emails
Performance differences
Who is being let go
Who is being brought in
What reasons management gives

Save screenshots and correspondence. Keep the records on your personal device, not company systems.

Use the proper reporting channels.

If you feel you have nothing to lose, document the internal complaint carefully. Consider getting an attorney involved. In some cases, a letter from counsel can help protect you while the issue is being investigated.
Watch for retaliation.
Keep the report factual and focused on possible compliance failures, including:
False attestations

Worker displacement

Misrepresentation

Lack of good-faith recruitment

Sudden changes in performance reviews
Exclusion from meetings
Demotion
Removal of responsibilities
If retaliation begins, document it immediately. Depending on the facts, federal whistleblower or anti-retaliation protections may apply.
Consider speaking quietly with an employment attorney before the situation escalates.
The law can protect people who report genuine violations. Companies that systematically replace American workers with H-1B labor may be violating the spirit of the program and, in some cases, the law itself.
