This is incorrect. The judge had expressed concern over Kingston's right to a speedy trial. If the prosecution refiles charges at some later date, it is possible - perhaps even probable - the defense can get another dismissal, but next time with prejudice.

Remember, the prosecution already waited nearly a year after the alleged incident to file charges. The alleged victim waited four days to report it. And after all this time, she's still unable to testify? (Unable or unwilling?)

In its last motion for a continuance, the prosecution wanted a September trial but said they still might not be ready to proceed even then. The case was always weak and has now gotten much weaker.
