TWU Local 100 scored a win this week with Tier 6—the cap on OT counted toward our pensions jumped from $21,589 to $30,000, with an additional 3% to be added each year after.
This is just the latest positive change in the years we have fought for improvements to Tier 6.
In 2012, we were able to retain 25/55 retirement. In 2022, the vesting period was slashed in half from 10 years to 5, and OT
exempted from bumping members into a higher contribution band. In 2024 the Final Average Salary calculation was switched from being based on the highest 5 years of a member’s earnings to the highest 3 years.
All of these changes were results of the commitment and participation of members in rallies, our yearly Lobby Day trips and constant advocacy campaigns.
There are still improvements to be made, including lowering the contribution rate for all workers, further reducing or eliminating the OT cap and fixing the early retirement penalties.

📣 Tier 6 Victory in State Budget
After weeks of deliberations, a deal for the New York State budget was announced today that included a big win for Tier 6 transit workers.
The budget will enact a significant boost to the “overtime cap”, which is the statutory ceiling on pensionable earnings for members hired April 1st, 2012 and after.
Currently set at $21,589, the cap will jump to $30,000 by next year— the biggest single increase so far. What that means for you is more overtime will count towards your pension, improving your retirement benefit.
The cap, which was originally $15,000 in 2012, will also increase each year by 3%.
President John V. Chiarello praised the reform, and credited the membership for being involved in the fight.
“This victory is the result of diligent lobbying efforts and member support” said Chiarello. “These changes do not happen overnight, but together we will keep fighting for the equity we deserve.”
In addition to the cap increase, the practice of excluding overtime earnings in determining a members’ pension contribution rate will be extended through January 1, 2029. This keeps members who earn overtime from being assessed a higher contribution percentage.

According to the New York Post, the MTA secretly spent OVER $10 MILLION on outside legal fees — and they admitted that may only be the “tip of the iceberg.”

…but somehow there’s ALWAYS unlimited money for consultants, contractors, and lawyers.
And let’s stop pretending this is normal.
