FIR is an allegation. Not a conviction. And the Supreme Court has repeatedly said it clearly … the power to arrest is NOT the necessity to arrest.
In Arnesh Kumar case , the Court said police must ask three basic questions …
Why arrest?
Is it necessary?
What purpose will it serve?
So the same logic applies here…
The alleged “evidence” is a social media video. It is already public. So why the 2:35 AM arrest?
Was he going to delete a video that thousands had already seen? Destroy evidence sitting on the internet? Flee the country?
Or was arrest simply the easiest thing to do once the FIR was filed? Or was it an ego satisfying exercise of power?
Article 21 matters. Personal liberty is not a favour the State grants … it is a constitutional right.
Article 22 matters too. It exists precisely to protect citizens from arbitrary arrest and detention.
But who cares about Article 21 and Article 22 when politicians allegedly weaponise the police to silence critics, settle political scores and satisfy their egos?
The very politicians who claim to be the “saviours of the Constitution” are accused of using the machinery of the State against those who question them.
