The direction is right. The proposed move from €6B to €100B is progress. But if Europe wants tokenized capital markets to actually scale, €100B is simply not enough.
And the important detail is that this is market capitalization, not trading volume. Some European projects already represent volumes of up to €350B. A €100B ceiling can become a constraint before the market has even had the opportunity to properly develop.
Our preference is simple: remove the cap for the regular regime.
If policymakers want to keep one, €1.5T is a much more realistic baseline, combined with the ability for the Commission to increase it as markets grow, without another hard ceiling above it.
There is another point in the letter that I think matters a lot: don’t create different scaling limits depending on which type of regulated infrastructure is doing the exact same thing. Same business, same risks, same rules. Otherwise we are protecting incumbent structures rather than creating a level playing field for new market infrastructure.
Europe has done something important by creating a regulated path for tokenized markets. Now it needs to make sure that path is actually wide enough to build a market on it.

Checked the chain and it seems like ~200m worth of rsETH was stolen, not minted out of thin air.
The attacker deposited the stolen funds in Aave to borrow WETH.
The position is technically backed, meaning @aave should have no bad debt.

I think there are two separate layers getting mixed here: legal ontology vs system design.
The taxonomy is useful, especially the distinction around “instruction tokens.” But I think the framing goes too far when it treats “instruction” as something ontologically inferior.
A security is not a physical object. It’s a legal relationship - an abstract set of rights. Everything we’ve ever used - paper certificates, book-entry systems, CSD ledgers - are just representations of that abstraction. None of them is the security in any fundamental sense.
If you want to get a bit Kantian about it: the security is the noumenon, the thing-in-itself as a bundle of legal rights. Everything else - certificates, ledgers, tokens - are phenomena, the ways we represent and interact with that abstraction. Arguing that one representation is “real” and the others are “just instructions” is mixing levels.
You could run the same critique backwards:
•a paper certificate can be lost and reissued
•a book-entry can be updated or corrected
•a transfer agent ledger is just an authoritative database
So calling tokens “just instructions” doesn’t really disqualify them. It places them in the same category as every other system we’ve used to represent ownership.
From that perspective, what matters is not whether the token is “pure bearer” or “chain-as-ledger,” but whether the system as a whole defines a clear, enforceable source of truth.
That’s where models like DS Protocol are often misunderstood.
The goal is not to pretend the token magically is the security in isolation. The goal is to create a system where:
•the token is the canonical interface for ownership and transfer
•the legal record and the onchain state are tightly coupled
•and the parties with legal responsibility (issuer, transfer agent) are explicitly part of the system, not hidden behind it
That’s not “intermediary cosplay.” It’s making the intermediary layer explicit, programmable, and verifiable.
The “key exchange = ownership” test is elegant, but it’s effectively a test for bearer instruments. And we already know why the system moved away from that model - AML, governance, investor protection, dispute resolution. Those constraints don’t disappear just because we use blockchain.
If you need:
•KYC/AML enforcement
•the ability to block or unwind unlawful transfers
•shareholder identification for voting and legal rights
then some form of controlled, accountable registry is not optional. It’s the system requirement.
So the real question is not “can we eliminate intermediaries?” but “can we redesign them so they are minimal, transparent, and interoperable with onchain systems?”
That’s exactly the space DS Protocol is operating in.
Market reality matters here too. The traction we’re seeing is not accidental - it’s because these models actually map to how securities law works today while still unlocking distribution, programmability, and new market structure.
So yes, great ontological framing. But the conclusion feels too binary.
The security is the abstraction. The token is one way to represent it. And the system around it is what makes it actually work.
