The Finance Minister has proposed a landmark update in the new Income Tax bill - bringing Virtual Digital Data under the legal scanner.

📌 First, what is "𝐕𝐢𝐫𝐭𝐮𝐚𝐥 𝐃𝐢𝐠𝐢𝐭𝐚𝐥 𝐒𝐩𝐚𝐜𝐞"? as per new Income Tax bill:
✅ Email servers
✅ Social media accounts
✅ Online investment, trading & banking accounts
✅ Websites storing ownership records of assets
✅ Remote/cloud servers
✅ Digital application platforms
✅ Any other similar digital environment

𝐖𝐡𝐲 𝐓𝐡𝐢𝐬 𝐂𝐡𝐚𝐧𝐠𝐞?
Until now, the Income Tax Act (1961) only talked about physical records—books, papers, files.
There was no clear law on accessing digital content like your phone, App chats, encrypted drives, or cloud backups during a tax investigation.
As a result, officers couldn’t legally demand passwords or evidence hidden in chats, apps, or digital wallets.

𝐀 𝐅𝐞𝐰 𝐄𝐲𝐞-𝐎𝐩𝐞𝐧𝐢𝐧𝐠 𝐂𝐚𝐬𝐞𝐬 𝐭𝐡𝐚𝐭 𝐃𝐫𝐨𝐯𝐞 𝐭𝐡𝐢𝐬:
1. ₹250 Cr in black money uncovered via decoded encrypted chats
2. ₹90 Cr in crypto assets traced through WhatsApp conversations
3. ₹200 Cr in fake billing revealed using digital messages
4. ₹150 Cr in manipulated capital gains linked to professional group chats
5. Google Maps history helped uncover hidden cash locations
6. Instagram accounts led to luxury cars tied to benami assets

As Chartered Accountants, we play a dual role - as facilitators of compliance and custodians of integrity. This shift invites us to be more proactive in digital record-keeping, data trail awareness, and advising clients on lawful digital conduct.
