🚨 Pete v. Cooper Update:

Milagro has formally filed a Notice of Appeal from Judge Cecilia Altonaga’s paperless denial of her Rule 60(b)(6) motion raising an appearance of partiality issue under 28 U.S.C. § 455(a).

That motion argued that an objective observer could reasonably question the appearance of impartiality based on Judge Altonaga’s husband’s prominent position at Holland & Knight, a firm with longstanding ties to Roc Nation and Megan Thee Stallion related matters. Holland & Knight currently represents Desiree Perez in the Hadley litigation in the same district, previously represented Megan in litigation involving 1501, and is now representing Megan and her companies in the Emilio Garcia case.

Milagro is asking the Eleventh Circuit to review whether the district court abused its discretion in denying that Rule 60 motion.

This is separate from Milagro’s main appeal, which is already pending and challenges the original judgment, jury verdict, amended judgment and the order reinstating the defamation claim.

So she now has the underlying judgment appeal moving forward while separately seeking appellate review of the Rule 60 and § 455(a) issue. If successful, that separate appeal could potentially provide an additional avenue for relief even if she does not obtain everything she is seeking through the main appeal.
