@ErnMarkham@EDOLawyers The decision of the NT does have a relationship with the Commonwealth by virtue of the recommendations in the Pepper Review which fall within control of the Commonwealth, particularly a recommendation the “water trigger” apply to NT Gas projects. This, to date, hasn’t occurred.
There’s plenty that’s problematic about the NT Gov’s announcement today that they’ll allow fracking production in the #NTAustralia, particularly with a range of key recommendations from the Pepper Inquiry outstanding.

Today the NT Supreme Court is hearing a crucial test case on the calculation of mining security bonds. In this instance the case relates to the McArthur River Mine - but mine rehabilitation and who ultimately carries the cost is a nation-wide issue of real importance.
