The debate on the Election date is getting interesting because people have always worked with terms based calendar years which are not mentioned in the Constitution (other than in the case of MCAs). But it is pretty a straight forward matter which we should have settled with the previous election which in essence complicated the count.
Let’s use Article 259 (5c): “In calculating time between two events for any purpose under this Constitution, if the time is expressed… as years, the period of time ends at the beginning of the date of the relevant year that corresponds to the date on which the period began.”
1st year: August 9, 2022 to August 9, 2023
2nd year: August 9, 2023 to August 9, 2024
3rd year: August 9, 2024 to August 9, 2025
4th year: August 9, 2025 to August 9, 2026
5th year: August 9, 2026 to August 9, 2027
This means that for the current electoral term, “Second Tuesday of August in the 5th year” falls on August 11, 2026.
Good thing is that the High Court suspended the judgement to allow IEBC to correct the anomaly after the 2027 election.
