Client is going to keep a $1 million ERC after going through an IRS audit (work was completed by a mill as we told them they weren't eligible). Online, catalog retailer, revenues up, not impacted by gov order. Argued supply chain and a reduction in work hours #taxtwitter 1/x

@danchodan I have one client that received a refund check dated 10-17-23 but that was tied to an IRS audit of the ERC that wrapped up successfully on 9-6-23, so likely an outlier case. Not aware of any other “normal” ERC refunds paid

Put any Leyton (https://t.co/1u7pnTYOeI) ERC calculations on watch. They left significant dollars on the table...probably too busy counting all that cash (20% fee)!

@danchodan #taxtwitter battling with an ERC mill that took my client for a ride...overly simplified example: Lets say a company had $200k of wages in an ERC-eligible quarter. PPP loan of $50k during this period, too. Can the $150k of 'excess' wages be considered for ERC?
