NHS TRUST MAKES HISTORY AS FIRST EVER CRIMINALLY PROSECUTED FOR UNSAFE CARE

In November 2017 Harry Richford was born by emergency caesarean at Queen Elizabeth The Queen Mother Hospital in Margate, run by East Kent Hospitals @EKHUFT. His heartbeat had been dropping for hours during labour. He died seven days later from a lack of oxygen.

Here is the shocking part.

The trust did not report his death to the coroner. They logged it as expected. As if a newborn dying a week after birth was just routine paperwork and not a catastrophic failure on the labour ward.

Tom and Sarah Richford had to fight their own hospital just to get an inquest opened. They got one.

In January 2020 the coroner ruled Harry's death was wholly avoidable and contributed to by neglect. The locum doctor who delivered him had not even had his competency properly checked first. Basic @NHS quality control, apparently optional that day.

Care Quality Commission @CareQualityComm then did something it had never done before.

It criminally prosecuted an NHS trust over unsafe care, the first case of its kind.

East Kent pleaded guilty in 2021 and was fined £733,000. Historic moment, everyone said. A fine that probably barely touched the comms budget, I would add.

The fallout kept spreading. Dr Bill Kirkup's later independent review found more than 200 families had been failed at the trust between 2009 and 2020, and that 45 of the 65 baby deaths examined might have ended differently with proper care. At least eight separate moments where trust leadership could have stepped in and chose not to.

North Thanet MP Sir Roger Gale @SirRogerGale praised the Richfords for their courage and dignity. Lovely sentiment. Would have landed better if the hospital had told the truth first and left the praising to someone else.

East Kent's maternity units were finally rated good by the CQC in December 2024. Real improvement, worth saying out loud. It just took a dead baby, a furious family, a criminal prosecution and a national investigation to get there. Call that the bare minimum, arriving seven years late.

The real story is an institution that got to decide internally whether its own failure deserved scrutiny, until a grieving family forced the question into open court.
