Please fix this, all disability ratings should be paid by the VA not stolen from the DoD retired pay earned.
Only Congress can change or fully remove the offset rule, as it is established by federal statute (primarily under Title 10 U.S.C. for military retirement and Title 38 U.S.C. for VA benefits). The offset—requiring military retirees to waive a portion of their DoD retired pay equal to their VA disability compensation—dates back decades to prevent what was viewed as "double-dipping." Partial relief came through laws like the FY2004 NDAA, which created CRDP (for 50%+ ratings) and CRSC.
