The 2022 judgment found that the poor #airquality in the Highveld Priority Area is in breach of residents’ section 24(a) Constitutional right to an environment that is not harmful to their health and well-being.
In her judgment, Justice Colleen Collis found that, while not all #airpollution violates the right to a healthy environment, “if air quality fails to meet the National Ambient Air Quality Standards, it is a prima facie violation of the right" #Section24#DeadlyAir
WHY IT MATTERS: This case arrives at a time when legal protections against #airpollution are under severe threat. Recent decisions by former Minister Creecy and current Minister George have granted significant exemptions to major polluters like Eskom, Sasol, and ArcelorMittal
